A legal analysis of the proposed legislation on the civil aspects of the international child abduction bill, 2016 in India

Abstract: The right of the Child is of immense value as they are the future of the country. When we talk about human rights it is most important to emphasize on the child rights. In the field of child abduction law some new legislation is being done. This paper analyses the issues relating to international child abduction and the civil aspects of the International Child Abduction Bill 2016. This happens when one parent takes the child back to their native country without the consent or agreement of the other parent. The Legislature in India has taken initiative to solve the problem by drafting the Civil Aspects of International Child Abduction Bill, 2016. This paper discusses various important expressions which have been defined under this draft Bill. It also examines the wrongful removal or retention of child in India including the Legality of Right of Custody in India and the constitution, powers and functions of the central authority. The very important role of the central authority and the High Court has been discussed.
